NIC Responds to Petition for EPA to Regulate Nanoscale Silver as Pesticide

ICTA Petitions EPA to Regulate Nanoscale Silver Particles as Pesticide: NIC Responds In November of last year, as many of you know, the International Center for Technology Assessment (ICTA), Friends of the Earth and others submitted a Petition for Rulemaking Requesting EPA Regulate Nanoscale Silver Particles as Pesticides. A little digging into the matter revealed, without much surprise, how many of those entities who endorsed the petition have received funding from pharmaceutical companies, and the public is all too aware of the long-standing battle the pharmaceutical industry has been engaged in to limit consumer access to natural products, dietary supplements, vitamins and other alternative remedies. As with most proposed regulatory action, those presenting it hope for swift enactment without much public discourse. Initially, EPA welcomed public comments only up until January 20th, which would prevent those interested and affected from having sufficient time to learn about the petition, understand its contents and how it would impact their consumer choices; also to gather whatever science is available and understand what rulemaking exists to counter the petition, and therefore avert such capricious and arbitrary action on behalf of a regulatory agency. Before the initial deadline, a number of groups, including NIC and even the ICTA, filed requests for an extension to the comment period which, once granted, postponed the deadline to March 20. Last week, NIC submitted via counsel its response to the petition, and were encouraged by the volume of other responses by the public opposing the petition. We wish to thank all those who sent comments and who remain committed to fighting for their health sovereignty and rights as consumers.
